By accessing and using Galaxy Fishing ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. Description of Service

Galaxy Fishing is a mobile application that provides:

• Fishing spot recommendations
• Catch logging and tracking
• Trip planning and scheduling
• Weather and environmental data
• Community features and social interaction

3. User Accounts

3.1 Registration

• You must provide accurate information
• You must be at least 13 years old
• One account per person
• You are responsible for account security

3.2 Account Security

• Keep your password confidential
• Notify us immediately of unauthorized access
• You are responsible for all activities under your account

3.3 Account Termination

• We may suspend or terminate accounts for violations
• You may delete your account anytime in Settings
• Content may be retained for legal requirements

4. User Content

4.1 Your Content

• You retain ownership of photos, catch logs, posts
• You grant us license to display, store, and distribute your content
• You must have rights to content you upload
• You are responsible for your content

4.2 Content Standards

You agree NOT to post content that:

• Violates laws or regulations
• Infringes intellectual property rights
• Contains hate speech or harassment
• Is sexually explicit or pornographic
• Promotes violence or illegal activities
• Contains spam or malware
• Violates others' privacy

4.3 Content Removal

• We may remove content that violates these terms
• We may remove content for any reason
• No compensation for removed content

5. Prohibited Activities

You agree NOT to:

• Violate any laws or regulations
• Impersonate others or misrepresent affiliations
• Interfere with or disrupt the App
• Attempt unauthorized access to systems
• Use automated systems (bots, scrapers)
• Reverse engineer the App
• Resell or redistribute the service
• Harvest user data without consent

6. Fishing and Safety

6.1 Disclaimers

• Not a Substitute: App is not a substitute for knowledge, skill, or judgment
• Weather Data: Weather information may be inaccurate or delayed
• Spot Information: Fishing spot data may be outdated or incorrect
• Safety: You are responsible for your own safety
• Regulations: You must comply with local fishing laws and regulations

6.2 Assumption of Risk

Fishing involves inherent risks. By using this App, you assume all risks associated with fishing activities. We are not liable for injuries, property damage, or other losses.

7. Intellectual Property

7.1 Our Rights

• App design, code, and features are our property
• Galaxy Fishing name and logo are our trademarks
• Fishing spot data compilation is our property
• All rights reserved unless expressly granted

7.2 Limited License

• We grant you limited, non-exclusive, non-transferable license to use the App
• For personal, non-commercial use only
• License terminates if you violate terms

8. Subscriptions and Payments

8.1 Free Features

• Basic spot browsing
• Limited catch logging
• Basic trip planning

8.2 Premium Features

• Unlimited catches
• Advanced AI recommendations
• Exclusive spots
• Priority support

8.3 Payment Terms

• Charged through Apple App Store
• Subscriptions auto-renew unless cancelled
• Refunds per Apple's policies
• Prices subject to change with notice

9. Disclaimers and Limitations

9.1 "AS IS" Basis

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Warranty

• We don't guarantee accuracy of fishing spot data
• We don't guarantee weather forecast accuracy
• We don't guarantee the App will be error-free
• We don't guarantee uninterrupted service

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR: indirect, incidental, special, or consequential damages; lost profits or revenues; data loss; personal injury or property damage; fishing-related accidents or incidents.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS.

10. Indemnification

You agree to indemnify and hold us harmless from claims, damages, losses, and expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of others' rights
• Your content

11. Changes to Terms

We may modify these Terms at any time:

• Notice: Via in-app notification or email
• Effective: Changes effective immediately upon posting
• Continued Use: Constitutes acceptance of new terms

12. Termination

12.1 By You

• Delete your account anytime in Settings
• Downloaded data removed from your device
• Server data deleted within 30 days

12.2 By Us

• We may terminate for Terms violations
• We may terminate for extended inactivity
• We may terminate for any reason with notice

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law provisions.

13.2 Arbitration

Disputes shall be resolved through binding arbitration, not courts, except: small claims court matters, injunctive relief, and intellectual property disputes.

13.3 Class Action Waiver

You agree to resolve disputes individually, not as part of class action or representative proceedings.

14. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and us.
• Severability: If any provision is invalid, the rest remains in effect.
• No Waiver: Our failure to enforce any right doesn't waive that right.
• Assignment: You may not assign these Terms. We may assign to affiliates or successors.
